The Supreme Court on Monday decided to hear an appeal from a Virginia man who was convicted for making threats against his ex-wife and former co-workers on Facebook(s fb). The man made repeated references to guns, explosive and killing, but tried to claim that, in his mind at least, these were not real threats, and that the statements were protected by the First Amendment. Some news outlets have suggested the court is about how illegal threats laws apply to Facebook or other social media; -- the lower court decision makes clear, however, that the case is primarily about a test for "subjective" versus "objective" intent requirements under criminal law.
